Welcome to NovaChat (the "App"), provided by Craftixel Apps ("we", "us", "our"). These Terms of Use ("Terms") govern your use of the App. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The Service

NovaChat is an AI-powered assistant that lets you chat, ask questions by text, voice or image, and use tools such as the career assistant. The App does not require an account. Some features are available only with a paid subscription.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of majority, you may use the App only with the consent of a parent or guardian.

AI-Generated Content

  • Responses are generated automatically by AI and may be inaccurate, incomplete, outdated or offensive. Always verify important information independently.

  • The App does not provide professional medical, legal, financial, career or other expert advice. Do not rely on it as a substitute for a qualified professional.

  • You are responsible for how you use any output, including resumes, cover letters or messages you create with the App.

  • Similar prompts may produce similar responses for other users; output is not guaranteed to be unique.

Acceptable Use

You agree not to:

  • Use the App for any unlawful, harmful, fraudulent, harassing or deceptive purpose;

  • Generate or share content that infringes others' rights, exploits minors, promotes violence or hate, or violates applicable law;

  • Upload content you do not have the right to share, including other people's personal information without consent;

  • Attempt to reverse-engineer, scrape, overload, bypass limits of, or interfere with the App or its servers;

  • Resell or provide the App's output as an automated service without our permission. We may suspend or terminate access if we reasonably believe you have violated these Terms.

Your Content

You retain any rights you have in the content you submit and in the output generated for you, to the extent permitted by law. You grant us a limited licence to process your content solely to operate and provide the App, as described in our Privacy Policy.

Subscriptions and Payments

  • Premium features are offered as auto-renewable subscriptions (weekly, monthly or yearly). Prices are shown in the App before purchase.

  • Payment is charged to your Apple ID account at confirmation of purchase.

  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

  • You can manage or cancel subscriptions in your Apple ID account settings (Settings > your name > Subscriptions). Deleting the App does not cancel a subscription.

  • Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription. • Refunds are handled by Apple under its policies; we cannot issue refunds directly.

Intellectual Property

The App, including its design, software, text, graphics and trademarks, is owned by Craftixel Apps or its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in line with these Terms and Apple's Usage Rules.

Third-Party Services

The App relies on third-party services, including Apple, Google Firebase, Google Cloud and AI model providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.

Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle information.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted, error-free or that output will be accurate.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or opportunities, arising from your use of or inability to use the App or reliance on AI output. Our total liability for any claim will not exceed the amount you paid us for the App in the 12 months before the claim.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms.

Changes and Termination

We may modify or discontinue the App or update these Terms at any time. Updated Terms take effect when posted in the App, and continued use means you accept them. You may stop using the App at any time.

Apple-Specific Terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Where these Terms do not address a matter, Apple's Standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies.

Governing Law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in India, without limiting any mandatory consumer protections in your country of residence.
